Sometimes, we walk into this world without understanding our existence and at the rarest moments; we even find it meaningless. However, we still want to wake up every day. We defend ourselves whenever we feel harmed. Our law protects us at times that we cannot. The Government makes guidelines to safeguard us from intruder of our rights. But how well do we understand the law?
Let us begin with something that we can live by day to day (because we never know when we’ll need it) - The Miranda Rights. Who is Miranda? Miranda is Ernesto Arturo Miranda. He was taken to custody for robbery, kidnapping, and rape of a mentally disabled woman.
Here’s the Miranda Rights:
You Have the Right to Remain Silent.
In any circumstance that will lead to an arrest, most often than not, the suspect is not in his sound mind. He might be under the state of shock, alcohol, or other outranging emotions. The suspect can exercise the right to say nothing at the time of arrest. His or her silence must be respected.
Anything You Say Can and Will Be Used Against You in a Court of Law.
It is always wise to speak with a lawyer first before saying anything to anyone at the time of arrest. One unintelligible word that will be said may cost the life or freedom of the suspect.
You Have the Right to an Attorney.
Although everyone is expected to know the law, they are not expected to comprehend them thoroughly. Knowing is not sufficient to defend one in the court - hence the need to have a lawyer.
If You Cannot Afford an Attorney, One Will be Appointed for You.
It is preferable that an accused will hire his lawyer that he is comfortable to handle his case. After all, it is his freedom and life that is at peril. The court may, however, appoint an attorney if the suspect can’t afford to have one.
